Regulated statutes

JR CONSEIL operates under four complementary statutes, which structure all of its dealings with clients.

Financial Investment Adviser (CIF)

JR CONSEIL is listed on the single register of insurance, banking and finance intermediaries (ORIAS) under number 07 00 05 71, as a Financial Investment Adviser. The firm is a member of the National Chamber of Wealth Management Advisers (CNCGP), a professional association approved by the French Financial Markets Authority (AMF).

Insurance brokerage firm (COA)

Insurance broker listed on the single register of insurance, banking and finance intermediaries (ORIAS) under number 07 00 05 71, classified under category «b»: the firm is under no contractual obligation to work exclusively with one or more insurance undertakings.

Banking and Payment Services Intermediary (IOBSP)

Listed on the single register of insurance, banking and finance intermediaries (www.orias.fr) under number 07 00 05 71, JR CONSEIL operates as a non-exclusive agent in banking transactions and payment services.

Bank and financial canvasser

JR CONSEIL carries out banking and financial canvassing activities in accordance with Articles L.341-1 et seq. of the French Monetary and Financial Code.

Supervisory authorities

JR CONSEIL's activities are supervised by two independent French authorities.

French Financial Markets Authority (AMF)

The AMF is the regulator of financial markets in France. It approves the CNCGP, the association of which JR CONSEIL is a member, and supervises the activity of Financial Investment Adviser (CIF).

French Prudential Supervision and Resolution Authority (ACPR)

The ACPR, attached to the Banque de France, supervises the insurance brokerage and banking intermediation activities carried out by JR CONSEIL.

Professional association

As a Financial Investment Adviser, JR CONSEIL is a member of the National Chamber of Wealth Management Advisers (CNCGP), an association approved by the French Financial Markets Authority (AMF).

Membership of the CNCGP requires JR CONSEIL to comply with a professional code of conduct, an annual review procedure and an ongoing duty of continuous training.

Remuneration policy

Transparency of remuneration is one of the non-negotiable conditions of independent practice.

Depending on the nature of the service and the solution put in place, JR CONSEIL may receive the following forms of remuneration:

  • Advisory fees billed directly to the client, the amount of which is known and agreed before the service is provided;
  • Commissions paid by partner institutions (insurance companies, asset management firms, banking institutions) for placement or intermediation, the details of which are disclosed to the client before any subscription;
  • Management fee retrocessions received over the life of the contract, the method of calculation of which is set out in the contractual documentation given to the client.

In accordance with the provisions of the Insurance Distribution Directive (IDD) and the MiFID II directive, JR CONSEIL informs its clients, in writing and before any service is provided, of the full amount of remuneration received and of its potential impact on the net return of the proposed solution.

Conflicts of interest management policy

As a Financial Investment Adviser, JR CONSEIL has put in place a written policy for the prevention, identification and management of conflicts of interest, in accordance with the requirements of the AMF's General Regulation.

The firm has no capital ties with any banking institution, insurance company or distribution network. No business introducer is remunerated on the basis of the volume or nature of the products placed.

Where a situation could harm the client's interests, JR CONSEIL undertakes to inform the client clearly and in advance, and to propose a neutral alternative solution. Full details of the conflicts of interest management policy are available from the firm on request.

Complaints and mediation

Any client may, at any time, lodge a complaint with the firm or refer the matter to the competent mediator.

Lodging a complaint with JR CONSEIL

Any complaint may be sent free of charge to the firm by post or email. JR CONSEIL undertakes to acknowledge receipt within ten working days and to provide a reasoned response within two months at the latest, in accordance with the recommendations of the AMF and the ACPR.

Referral to an independent mediator

In the event of a persistent disagreement after the firm's response — or in the absence of a response after the two-month period — the client may refer the matter, free of charge, to the mediator competent according to the nature of the dispute:

Personal data protection (GDPR)

JR CONSEIL collects and processes personal data strictly within the scope of its wealth advisory engagements and its regulatory obligations (anti-money laundering, tax and contractual obligations). Processing is based on the performance of the advisory mandate, compliance with legal obligations and, where applicable, the client's explicit consent.

Data collected is strictly necessary for the service and is never disclosed to third parties for commercial purposes. It may be shared with contractual partners (insurance companies, asset management firms, banking institutions) only to the extent useful for implementing the solutions taken out.

In accordance with the General Data Protection Regulation (GDPR) and the amended French Data Protection Act, every data subject has a right of access, rectification, erasure, objection, restriction and portability of their data.

Anti-money laundering and counter-terrorist financing

JR CONSEIL is subject to the legal obligations relating to anti-money laundering and counter-terrorist financing (AML-CFT), as defined in Articles L.561-1 et seq. of the French Monetary and Financial Code.

As such, the firm operates a know-your-customer (KYC) procedure involving, in particular, verification of identity, understanding of the client's wealth situation, the source of funds, beneficial owners and the purpose of the business relationship. Constant vigilance is maintained throughout the contractual relationship.

The firm is required to file a suspicious activity report with TRACFIN (the French Ministry of Economy and Finance's financial intelligence unit) in the cases provided for by law, without being able to inform the client of this.

Professional civil liability

In accordance with the regulatory requirements applicable to its activities, JR CONSEIL holds a Professional Civil Liability insurance contract covering the financial consequences of damage caused to clients in the course of its engagements.

The cover amounts and the insurer's contact details are disclosed to the client before any contract is entered into, and are set out in the contractual documentation provided by the firm.
